Must Employee Give Notice of Injury or Illness to Employer? 

Yes

Must Notice Be in Writing?

State has no statutory requirements.

When Must Notice Be Given?

Within 30 days of the occurrence of the injury, or within 30 days of when employee knew or should have known of the disability and its relation to the employment. If no claim is filed with the department of industry, labor and job development within 2 years of injury or death, the claim is barred, unless employer had reason to know that employee had sustained the injury on which the claim is based.

Exemptions to Notice Requirements

Absence of notice does not bar recovery if it is shown that employer was not misled.

Effect of Failure to Notify Employer

None, unless employer was misled by the absence of notice.
