Workers Compensation Notice Requirements for Employees – OK

OKLAHOMA

Must Employee Give Notice of Injury or Illness to Employer? 

  Yes 

Must Notice Be in Writing? 

  No 

When Must Notice Be Given? 

Within 30 days of the injury. Notice of cumulative trauma or occupational disease must be given within 90 days of separation from employment. 

Exemptions to Notice Requirements 

If employer has knowledge of the injury. 

Effect of Failure to Notify Employer 

Presumption that injury was not employment related. This presumption must be overcome by a preponderance of the evidence.
